Applicants seek condonation of delay caused in filing application for setting aside abatement and bringing legal heirs of the sole claimant on record.

The legal heirs of the deceased claimant are the necessary parties. The cause of action survives against them. For the reasons stated in the application, it is desirable to condone the delay.
