By an order dated 18th December, 2015, passed in Bail Petition No.2183 of 2015, learned Additional Sessions Judge-4, Aurangabad, directed release of the applicant on bail, in C.R. No.I-212 of 2015, registered with City Chowk Police Station, Aurangabad, for offences punishable under sections 420, 406, 408, 467, 471 read with section 34 of the Indian Penal Code, upon depositing amount of Rs.80,00,000/- (Rupees Eighty Lakhs), in exercise of powers under section 439 of the Code of Criminal Procedure.

By the present application, relaxation of condition of deposit of amount of Rs.80,00,000/- (Rupees Eighty Lakhs) is sought for on the ground that the applicant owns a property bearing plot No.120, Gat
criap6907.15 (2) No.132, situated at Arunoday Colony, Beed By-pass, Aurangabad. It is claimed by the applicant that the valuation of the said property is Rs.62,38,650/-, which is based on the rates prescribed by the SubRegistrar for payment of stamp duty. 3.
In my opinion, it will be appropriate to grant the present application in view of the undertaking furnished by the wife of the applicant in the affidavit dated 13th January, 2016 and upon his release, the applicant shall furnish an undertaking to this Court, within a period of one week thereafter, that he shall not alienate or create charge over the said property and it will be subject to the outcome of the criminal trial, if any, arising out of the above referred crime.

Thus, the Criminal Application stands allowed in above terms. 5.
In view of above, Criminal Application No.250 of 2016, seeking permission to assist the Addl. Public Prosecutor, in the conduct of the present application, does not require any consideration. Thus, the said application stands disposed of.
