The learned counsel for applicants, on instruction, does not press the application of applicant No. 2 - Dipak Arjun Pawar in BA No. 2026/2024 (accused No. 3) . The application of applicant No. 2 - Dipak Arjun Pawar is accodingly dismissed.

Heard the learned counsel for the applicants, the learned APP for the respondents-State and Mr. N.J. Patil, learned advocate assisting APP.963

The applicants in above applications are seeking bail as they were arrested in connection with Crime No. 345/2023 dated 7.11.2023 registered with Itwara Police Station, District Nanded for the offences punishable under sections 302, 307, 384, 386, 294, 143, 146, 147, 148, 149 of Indian Penal Code and section 4 r/w. 25 of Arms Act and section 135 of Maharashtra Police Act.

Applicants - Kishan Raju Kuril and Anil Fakira Pawar in BA No. 2026/24 (accused Nos. 8 and 10) are arrested on 8.11.2023 and 2.12.2023, respectively. Applicant - Vishal Ghanshyam Rautre in BA No. 2114/24 (accused No. 7) is arrested on 8.11.2023. Applicant - Nitin alias Chota Chingya Sudhakar Jadhav in BA No. 2184/2024 (accused No. 11) is arrested on 22.11.2023. Applicant - Sainath Fakira Pawar in BA No. 2117/2024 (accused No. 16) is arrested on 7.12.2023. 6.
It is stated that accused No. 7 - Vishal Rautre has assaulted the informant by means of knife, however, the injury found on the informant was abrasion. It is stated that accused No. 8 - Kishan Raju Kuril was present on the spot of offence. It is alleged that accused No. 10 - Anil Fakira Pawar has assaulted the informant by means of fist and kick blows and also used stick during the incident. As regads accused No. 11 - Nitin alias Chota Chingya Jadhav is concerned, it is stated that he was holding the bag of swords. As regards accused No. 16 - Sainath Fakira Pawar is concerned, no role is attributed to him, however, his presence is noted during incident. 7.
The learned counsel for the applicants today has produced the copy of order dated 21.10.2024 in BA No. 1704/2024 and copy of dated 6.2.2025 in BA No. 2281/2024 in which accused Shubham Shivajirao Devrai (in BA No. 1704/2024) and accused Sayyad Imran Sayyad Gause @ Gausoddin (in
BA No. 2281/2024) are released on regular bail by this Court. The learned counsel submits that role of the released accused is similar to the present applicants. The learned APP has not disputed that the present applicants' role is identical to the above accused, who were released on regular bail. The learned counsel for assisting APP also could not distinguish the case of applicants from the accused, who are granted bail. 8.
Considering the same, the regular bail applications of above applicants are allowed in the following terms : a] The above applicants shall be released on bail in connection with Crime No. 345/2023 dated 7.11.2023 registered with Itwara Police Station, District Nanded for the offences punishable under sections 302, 307, 384, 386, 294, 143, 146, 147, 148, 149 of Indian Penal Code and section 4 r/w. 25 of Arms Act and section 135 of Maharashtra Police Act, on furnishing PR bond of Rs.20,000/-, each, with one or two sureties in the like amount to the satisfaction of the trial Court.
b] The above applicants shall not enter the jurisdiction of Itwara Police Station, Nanded during pendency of the trial. c] The above applicants, upon being released on bail, shall not contact the informant, in any manner whatsoever, during the pendency of the trial.
d] The above applicants shall co-operate with the trial Court and they shall attend each and every date, unless exempted by the trial Court, for reasons to be recorded in writing. e] The above applicants shall not tamper with the evidence of the prosecution and he shall not influence the informant, witnesses and
other persons concerned with the case.
f] The above applicants, upon being released on bail, shall place on record of the trial Court the details of their contact number and residential address with updates in case of any change. 9.
Needless to say, in case of violation of any of the aforesaid conditions, the bail granted to the above applicants shall be liable to be cancelled.

It is also clarified that the observations made in this order are limited to the disposal of the present bail applications. The concerned Court shall proceed further in the matter without being influenced by the observations made hereinabove.

All the applications stand disposed of.
