PER COURT :- An affidavit in reply has been presented on behalf of respondent Nos.3 and 4, wherein it is stated that it is the responsibility of Zilha Parishad and the concerned Village Panchayat to ensure removal of encroachment. It is informed that, Village Panchayat took steps and initiated a proceedings. A request was made by the Sarpancha of the Village Panchayat to provide Police protection for the purpose of removal of encroachment. However, Police protection was not provided.

If the Zilha Parishad/B.D.O. or Village Panchaat makes a request for providing Police protection for the purpose of removal of encroachment, respondent Nos.1 and 3 shall ensure providing of Police protection for the purpose of removal of encroachment. Necessary steps would be taken in that regard. Respondent Village Panchayat as well as the C.E.O. Zilha Parishad, Dhule shall ensure removal of encroachment, if any, in observance of the procedure, prescribed under law, as expeditiously as possible and preferably within a period of six months.
