The learned counsel for the respondent Nos.2 and 3 submits that the petitioner can assail his promotion before the Divisional Commissioner. 3.
In the light of above, though the petitioner sought to canvass his submission on merits, we are not inclined to consider the same.

The writ petition is disposed of with liberty to the petitioner to avail of the alternate remedy available in law. Considering the fact that the petitioner is retired, in case he files the proceeding
wp12468-2015 before Divisional Commissioner, Divisional Commissioner shall decide the same expeditiously and preferably within six months from the date of receipt of such proceeding. No costs.
