ORDER:- 1.

Heard learned counsel for the parties.

Pursuant to the order passed by this Court on 25.04.2014, respondent No. 2 was under obligation to release payment of Rs. 2,00,000/- in four equal installments. The last installment with additional sum of Rs. 20,000/- was to be paid on 30th September, 2014 . The amount was not deposited by respondent No. 2 according to said order and as such the present contempt petition has been filed.

Under order dtd. 13.12.2016, statement of learned counsel appearing on behalf of respondent No. 2, that about 21 cheques signed by him have been issued and handed over to the learned counsel appearing for the petitioner was recorded. The petitioner's counsel accepts the same. It is further stated, that 5 out of 21 cheques have been already encashed and that rest of the 16 cheques would be honoured in due course of time as and when those would be presented by the petitioner in the bank. Learned counsel for the petitioner has no particular grievance in respect of the same. 4.

Looking at aforesaid, the contempt petition is unlikely to carry any further purpose. The petition can be disposed of, leaving it open for the petitioner to take up appropriate proceedings including contempt proceedings in case of dishonour of any one of the cheques.
