Heard the learned counsel for the applicant- MIDC and the learned counsel for the proposed L.Rs. of deceased original claimant- Sheshrao Deorao Deshmukh as well as learned AGP for the respondent-State.

The learned counsel for the appellant submits that the respondent Sheshrao died in the month of May, 2015. There are legal heirs of deceased-respondent-Sheshrao and the applicant is requesting to bring his legal heirs on record. Hence, the applicant acquiring body preferred the present application to grant permission for bringing the L.Rs. of deceased Sheshrao on record. 3.

In view of nature of the subject-matter and submission on behalf of proposed L.Rs. of deceased Sheshrao, there is no impediment to allow the application. Accordingly the application is allowed in terms of prayer clause- A to C. Delay caused for filing the

The abatement of the proceedings following the death of deceased Sheshrao stands set aside and quashed and the applicant Acquiring Body is permitted to bring the L.Rs. of deceased Sheshrao on record within two weeks. Accordingly, application stands disposed of.
