This Appeal from Order can be disposed off by consent. The learned counsel for both the parties agree that the interim order passed by this Court in the form of stay to the execution of the order passed on Exh.5 may be continued till the disposal of the suit and the suit may be disposed off in a time bound manner.

In view of the above submissions, on consent, I proceed to pass the following order :

ORDER

(i) The Appeal from Order is hereby partly allowed. (ii) The order passed below Exh.5, the same is substituted by the interim order passed by this Court on 27.11.2017.

(iii) The Trial Court shall dispose off the suit, as expeditiously as possible, preferably within a period of one (1) year from the date of this order uninfluenced by the observations made by this Court while granting interim order of stay.

(iv) In view of disposal of Appeal from Order, nothing survives for consideration in Civil Application No. 14300 of 2017 and the same is also disposed off. (V. K. JADHAV, J.) ...
