The appellant-applicant moved this application seeking condonation of 35 days delay in filing appeal for the reasons set out in detail in the application.

Heard learned counsel for the appellant-applicant and Mr.F.K. Patel, learned counsel for respondent nos.1 to 8.

Mr. Patel undertakes to file Vakalatnama during the course of day. Respondent no.9 though served absent.

On due consideration of the submissions advanced in the light of unchallenged and uncontrovered pleadings made in the application seeking condonation of delay, I am of the view that the delay
