Heard learned counsel for the applicant and the learned APP for the respondent/State.

The applicant is apprehending arrest in connection with Crime No. 146/2024 dated 18.3.2023 registered with Cidco Police Station, Chhatrapati Sambhaji Nagar for the offences punishable under sections 406, 409, 420, 467, 468, 471 r/w. 34 of Indian Penal code.

It is the case of the prosecution that the applicant has shown to have purchased a fictitious flat, which is not in existence and the said flat is mortgaged to the bank by preparing the bogus documents. Considering the allegations made in the complaint, I deem it appropriate that this is not the case where relief of anticipatory bail can be granted. Custodial interrogation of the applicant is necessary for carrying complete investigation. 4.

In view of the above, the application is rejected. 5.

It is clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
