The learned Advocate for the Appellant - Insurance Company submits that, this Appeal was preferred by the Insurance Company against the Judgment and Award dated 29.07.2024 passed by the learned Motor Accident Claims Tribunal, Latur in Motor Accident Claim Petition No.260 of 2018. He further submits that the claim has been finally settled before the Executing Court in MA.C.P. Regular Darkhast No.12/2025 (for short, 'Regular Darkhast') and therefore, Insurance Company wants to withdraw this Appeal. He tenders across the table copy of the Email from the Insurance Company along with the copies of the Award passed in the above referred Regular

-2Darkhast. The same are taken on record and marked collectively as 'X' for the purpose of identification.

In view of the above, the following order is passed.

O R D E R

(i) The Appeal is disposed off as withdrawn.

(ii) The amount deposited in this Court, be transmitted to the Executing Court for doing the needful in accordance with the settlement arrived at between the parties before the Executing Court. (iii) Award be drawn up accordingly.
