PER COURT:- 1.

The proposal seeking approval to the transfer of the petitioner from unaided to aided division is rejected.

Heard learned counsel for the petitioner and learned A.G.P.

The proposal basically is rejected on the ground of circular dated 28.06.2016.

We have in our judgment dated 04.07.2019 in Writ Petition No.1493/2018 with connected writ petitions held that some of the Clauses of the circular dated 28.06.2016 do not apply.

It has been accepted by the Education Officer in the impugned order that the appointment of the petitioner for probationary period was approved. Thereafter, after completion of probation period satisfactorily, services of the petitioner are continued on unaided post and same is approved by the Education Officer.

In light of that, impugned order is quashed and set aside. The Education Officer shall decide the proposal seeking approval to the transfer of the petitioner from unaided to aided division afresh in tune with the judgment dated 04.07.2019 in Writ Petition No.1493/2018 with connected writ petitions.

Writ Petition is disposed of. No costs.
