Learned counsel Shri. Tripathi holding for Shri. Nagargoje appears for respondent Nos. 4 to 8, caveators. The learned AGP appears for respondent Nos. 1 to 3. 2.

The proceeding is filed to challenge the order of stay made by the learned Additional Commissioner, Aurangabad in appeal filed to challenge the order of disqualification for not submitting returns of accounts for election in time. The said order was made on 13.12.2016 when the matter was filed on 15.11.2016 before the learned Additional Commissioner. The purpose of both the sides will be served if the direction is given to the learned Additional Commissioner to expedite the matter and decide the appeal within 45 days from today.

So, the petition is disposed of with a direction to learned Additional Commissioner to dispose of the appeal within 45 days from today. Parties are to appear before the Additional Commissioner on 11.1.2017.
