A Writ Petition is directly filed for challenging the order of the trial Court dated 27.3.2017 refusing temporary injunction, below application Exhibit 5. A Misc. Civil Appeal has to be filed for challenging the order of grant or refusal of temporary injunction. 2.

This petition is, therefore, disposed off and the petitioners would be at liberty to resort to a remedy as is otherwise permissible under the Code of Civil Procedure.

The time spent by the petitioner in this Court from 27.11.2017 till passing of this order would be a good ground for condonation of delay.
