This matter was heard for sometime. We have perused the Government Resolution dated 07.12.2021, more specifically clause 5 read with clauses 3 and 4.3. 2.

It is obvious that the appeal preferred by the Petitioner was maintainable before the Chief Executive Officer, Zilla Parishad, Osmanabad.

The learned Advocate for the Zilla Parishad submits, on instructions, taken after a pass-over, that the impugned order dated 19.10.2023 would be withdrawn by the Zilla Parishad and

In view of the above, this Writ Petition is partly allowed. The impugned order dated 19.10.2023 stands withdrawn on instructions from the Chief Executive Officer, Zilla Parishad, Osmanabad. The proceedings initiated by the Petitioner shall be restored to the file of the Chief Executive Officer, Zilla Parishad, Osmanabad, who shall issue notices for a hearing to all the stakeholders and after granting a reasonable opportunity of hearing, pass a reasoned order on the merits of the matter.
