Heard rival submissions. The applicant is seeking condonation of delay of 698 days. According to learned counsel for the applicant, the applicant was totally unaware about the offending vehicle in this matter being insured with present respondent No. 2 - Insurance Company. He got the said knowledge only during the pendency of execution proceeding. The learned counsel for the respondent Insurance Company strongly opposed the application. However, considering the statutory right of the applicant, the delay of 698 days stands condoned.

Appeal be placed for admission after removal of office objections, if any.
