IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

BENCH AT AURANGABAD WRIT PETITION NO. 64 OF 2016 Ashok s/o Nathu Mali .. Petitioner versus Shrikrushna Mali Samaj Hitwardhan Sanstha and ors.

.. Respondents ---- Mr. Kishore C. Sant, Advocate for petitioner CORAM :

SUNIL P. DESHMUKH, J.

DATE :

29th June, 2016 ORDER :

1.

Heard learned counsel for petitioner.

2.

Petitioner, aggrieved by order dated 09-09-2015 passed by Assistant Charity Commissioner, Jalgaon - Respondent no. 3 allowing application filed by respondent no. 2 seeking consolidation of all change reports of 2011 for hearing, is before this court. 3.

While filing say on application moved by respondent no.2 for consolidation of reports, petitioner had requested not to give any indulgence to the request of respondent no.2. The authority, however, taking into account grounds in said application as well as objections by present petitioner, considered it expedient to club all the change reports for speedy disposal and accordingly application has been decided.

WP-64.16.doc 4.

Learned counsel for petitioner urges that change report no. 1359 of be decided first and rest of the five change reports may be decided subsequently and change report no.1359 would lead in deciding the matters.

5.

However, I do not find any reason to meddle with order passed by the authority which is concerned with convenience of the parties and authority and is not worth to be interfered with in extra ordinary powers of this court. There are no cogent reasons pointed for disturbing the impugned order.

6.

Writ petition stands rejected.
