Notice to the respondents, Learned A.P.P. waives notice for respondent State.

Learned counsel for the applicant original accused submits that during the course of trial, the applicant was on bail and even after his conviction, the learned Special Judge, Majalgaon has suspended the order of sentence till the appeal period is over and also released the applicant on bail till the expiry of the said period. 4.

The applicant accused is convicted for the offence punishable under Section 354 (A) (1) (2) of I.P.C. and sentenced to suffer R.I.

-2for two years and to pay fine of Rs.500/- i/d to suffer S.I. for one month and also convicted for the offence punishable under Section 8 of the Protection of Children from Sexual Offences Act and sentenced to suffer R.I. for three years and to pay fine of Rs.1000/- i/d to suffer S.I. for two months. The applicant accused has also deposited the fine amount before the trial court. Hence, I proceed to pass the following order:-

O R D E R

I.

Criminal application is allowed.

II.

The substantive part of sentence, passed by the Special Judge, Majalgaon, dated 24.10.2016 in Special Case No. 7 of 2016, stands suspended till the disposal of appeal and till then applicant accused Hanuman Vikaram Surawase be released on bail on furnishing personal bond of Rs.20,000/- with one surety in the like amount, on the following conditions:- a) The applicant accused shall not enter within the limits of village Telgaon, Tq. Majgalgaon, District Beed and further attend the concerned police station once in a week on every Sunday between 10.00 to 11.00 a.m. till

-3the end of month of January, 2017.

Bail before the trial court. Humdast allowed. IV.

Criminal application is disposed of.
