The petitioner is aggrieved by the order dated 04-10-2017, passed by the Hon'ble State Minister, Food, Civil Supplies and Consumer Protection Department, Mantralaya, Mumbai-32. 2.

Though the learned Advocate for the petitioner addressed on the merits of the matter, this Court is not inclined to entertain the petition on merits. The impugned order cannot be sustained being contrary to the ratio laid down by this Court in Savitri Chandrakesh Pal Vs. State of Maharashtra & Ors. reported in 2010 (Supp.1) Bom. C. R. 482.

Admittedly, the Hon'ble Minister heard the matter on 24-042017 and has delivered the judgment on 04-10-2017. In the judgment cited (supra), this Court has given guidelines to the quasi-judicial authorities to deliver the judgment within three months from the date of hearing.

In that view of the matter, the impugned order is quashed and set aside. The matter is remanded back to the Hon'ble Minister for decision on merits, the same be decided expeditiously. 5.

All contentions of respective parties are kept open. 6.
