The petitioner seeks grant in aid.

Mr. Rodge, the learned counsel for Respondent No. 3 submits that the Respondent No. 3 had withdrawn the recognition of the petitioner institution.

Mr. Bhavthankar, the learned counsel for petitioner submits that

( 2 ) wp 12802.16 the petitioner had filed an appeal against the order withdrawing the recognition on 03.09.2005. Initially, the stay was granted subsequently stay is vacated and the appeal against the order withdrawing recognition is still pending.

As on the date the recognition of the petitioner institution is not in force it would not be possible to consider the requests of the petitioner. 5.

In case, the appeal of the petitioner is allowed, then the petitioner will renew its request as made in the present writ petition. The Director of Education shall decide the appeal pending with him after hearing all the parties on its own merits, in accordance with law, expeditiously and preferably within a period of six (06) months from today. Writ petition is disposed of. No costs.
