After hearing learned counsel for the parties, when this Court was not inclined to interfere with the impugned order, at that time, learned counsel for the petitioner sought leave to withdraw the petition with liberty to permit the petitioner to file a fresh transfer application with new grounds before the learned Sessions Judge, in accordance with law. He further submitted that till then, the criminal trial in S.C. No. 65/2020 shall not proceed. In response, the learned Special P.P. submitted that the prosecution will not proceed with the matter for fifteen days. His statement is accepted. 2.

Having considered the above, the petition is disposed of as withdrawn with liberty to file an appropriate application before the learned Sessions Judge in accordance with law. With the consent of both the learned 1 / 2

913-CRWP-1647-25.odt counsel, it is clarified that the criminal trial in S.C. No. 65/2020 shall not proceed till 09th January, 2026. Learned counsel for both parties submitted that they will cooperate with the learned Sessions Judge to dispose of the petition/application, if any, filed by the petitioner as early as possible.
