By this application, the applicant seeks an additional relief in pursuance to the order passed by this Court dated 11.09.2017 in Misc. Civil Application No.151/2017. This Court has directed the husband to pay Rs. 2500/- (Rs. Two thousand five hundred only) per hearing as conveyance and other charges for attending the Court proceedings. It is submitted that, the husband will have to bear a large financial burden if the matter gets prolonged as, on each date he has to pay Rs. 2500/- to the wife, subject to her attending the Court proceedings. He, therefore, prays that the proceedings before the Court in HMP No.357 of 2013, which is already four years old, be decided within a time frame.

The learned Advocate for the respondent-wife on instructions from her father, who is present in the Court has initially sought an adjournment. He has then submitted that there is no reason to direct the decision in HMP No.357 of 2013 to be decided within a time frame as a Writ Petition Stamp No.37623 of 2017 is instituted by him before the learned Single Judge of this Court praying for leave to re-examine her father. He therefore prayed that this application be dismissed.

Considering the above and the comparative hardships, I find that an innocuous pray which is reasonable has been put forth by the applicant-husband.

As such, this application is allowed. In addition to the order dated 11.09.2017 passed by this Court, the trial Court is directed to decide HMP No.357 of 2013 as expeditiously as possible and in any case on or before 30.09.2018. (RAVINDRA V. GHUGE, J.) Sameer/Dec-17
