After hearing for some time, when this Court expressed disinclination to grant any relief, learned counsel for the applicants, on instructions, seeks leave to withdraw review application with liberty to prosecute the application for stay which is pending before the Tribunal in Misc. Application No.20 of 2017. It is further submitted that the possession needs to be protected for four (4) weeks and the Tribunal shall not be influenced by the observations recorded in the judgment under review.

Learned counsel Mr. Bade Patil strongly opposes protection solicited by the applicants. However he concedes to extend protection for one week only as the Tribunal is seized with the matter.

Review application is permitted to be withdrawn with a liberty to prosecute the application for stay pending before the Tribunal which shall be decided on its own merits without being influenced by the observations recorded by this Court. The protection granted earlier shall be continued for a period of one (1) week i.e. upto 17.12.2025. The same shall stand vacated, thereafter automatically. The applicants shall not claim any equities for the protection granted by this Court in the present review application.

Review application is disposed of as withdrawn. Civil application for Delay 5.

For the reasons stated in the application, delay stands condoned.
