The learned counsel for the applicant submits that after dismissing of review petition, the applicant has obtained the certified copy of the order. However, the applicant could not prefer the appeal immediately due to paucity of funds. The applicant is above 70 years of age. 3.

The learned counsel for respondent No.1 submits that the applicant has not explained the delay satisfactorily.

Considering the above submissions made on behalf of the applicant and for the reasons stated in the application, the delay of 235 days caused in filing the second appeal is hereby condoned. The Civil application is allowed and disposed of.
