IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 902 WRIT PETITION NO. 32 OF 2017 YASHWANT BABARAO UBALE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Mr. Suryawanshi Prashant D. Addl. GP for Respondents 1 and 2 State: Mrs. M. A. Deshpande

CORAM

: S. V. GANGAPURWALA & K. L. WADANE, JJ.

DATE :

11th January, 2017 ORDER:

1.

Heard learned counsel for the respective parties.

2.

Learned AGP relies on the judgment of Full Bench of this Court in the case of Anant Vs. Chief Election Commissioner, reported in 2017 (1) Mh.L.J. 435 to state that if the elected Councilor does not produce validity within six months from the date of election, then such person is axiomatically disqualified.

3.

The relief claimed in the present writ petition is that the Committee be directed to decide the proceedings within three months from the date of the order. The effect would be one and the same. As such, no separate order is necessary.

4.

Writ petition disposed of. No costs.
