ORDER

1. Heard rival submissions.

2. The application is filed by the applicants for bringing themselves on record being legal representatives of deceased sole appellant, Gangubai Dagodaba Gore , who admittedly died on 18.05.2020 by condoning the delay of 928 days.

3. Though the application is opposed, by the learned counsel for respondent No.3/acquiring body, but considering the right to sue, the application stands allowed in terms of prayer clauses (a) and (b) subject to cost of Rs. 1500/-(Rs. One Thousand and Five Hundred only) to be deposited with Registry of this Court for utilization of High Court Dispensary, Bench at Aurangabad.

It is made clear that the applicants/appellants shall not claim any interest and statutory benefits in respect of the aforesaid delay period.

5. The appellants/claimants are directed to carry out the amendment within stipulated period. The application is accordingly disposed of.
