This is an Application by the Appellants for apportionment of amount in view of the death of original Appellant No. 3 - Madhukanta.

Heard the learned Advocates for the Applicants/Appellants, Respondent No. 1 and Respondent No. 2.

The First Appeal is finally decided and the amount of enhanced compensation was directed to be apportioned within the three Appellants. Before the Judgment in the Appeal was delivered, the Appellant No. 3 - Madhukanta died. The copy of Death Certificate is on record. There is no dispute in that respect. The Appellants / Applicants No. 1 and 2 are the original claimants. In this view of the matter, the Application is allowed in terms of prayer clause 'B' thereof and disposed off.
