1] By the present writ petition, the petitioner challenges order dated 18.11.2025 passed by the Returning Officer.

2] The petitioner objected to the nomination form of the respondent candidate on the ground that there is illegal construction at the hands of the respondent candidate so also there are contradictory statements made on oath as to usage of constructed toilets. The objection of the petitioner was rejected by the Returning Officer and the nomination of the respondent candidate is accepted. Thereafter, the petitioner filed Election Appeal No.3/2025 before the District Court at Parbhani. The Appellate Court

14224.25WP has observed that the Returning Officer has rightly relied on the information fill up in the nomination form and the declaration by respondent no.2 at the time of scrutiny of her nomination. The appellate Court further observed that the respondent no.2 is residing in the house owned herself or the house owned by her husband makes no difference regarding use of regular toilet by her.

3] The list of nominated candidates is published and symbol of the candidate is also allotted. Considering the same, this Court in exercise of writ jurisdiction would not interfere in the ongoing election process. As such, the Writ Petition is disposed of, with liberty to the petitioner to avail statutory remedy as is available in law.
