A.P.P. for Applicant : Mr. P.K. Lakhotiya .....
CORAM : SHIVKUMAR DIGE, J.
DATED : 25th JUNE, 2024.
PER COURT :- 1.
Heard learned A.P.P. for the applicant in both the matters. 2.
It is the contention of the learned A.P.P. that the trial court has allowed the bail applications without considering the merits of the case. Hence, it is necessary to cancel the bail. 3.
It is the contention of the learned counsel for the respondents that respondents had challenged the report of the local
acb247.23 -2Laboratory to the National Laboratory. In the report of National Laboratory, it is mentioned that there was no chemical found in the product. The product itself is phosphate and there is no ground to cancel the bail.
4.
I have heard both the learned counsel. Perused the impugned order. While granting bail, the trial court has passed reasoned order. Moreover, the respondents have challenged the testing report issued by the State Laboratory before the National Laboratory and as per the report of National Laboratory, there was no chemical found in the product. Considering this fact, the order granting bail to the respondents, passed by the trial court, is legal and valid and I pass the following order:-
O R D E R
Both the applications are rejected.
