This application is filed by the wife seeking transfer of proceeding of Petition A No. 263/2023 from the Court of learned Judge, Family Court, Latur to the Court of learned Judge, Family Court, Pune.

It is the case of the wife that, she is residing at Pune with her two children aged three years and six years. The distance between Latur and her place is more than 300 Kms. She find it

2 945-MCA 380-2024.odt difficult to travel to Latur with children. There is one proceeding pending in the Court of learned J.M.F.C. seeking maintenance from respondent-husband bearing Criminal Misc. Application No. 202/2024. A petition for divorce is also filed and is pending in the Court of learned Civil Judge Senior Division, Pune bearing H.M.P. No. 1446/2023. The learned advocate thus submits that, it is necessary to transfer the proceedings filed by the husband at Latur to the Court at Pune.

Since the respondent has not appeared in spite of service, it appears that he has no serious objection to the application. 6.

Considering the above, following order :

ORDER

(I) Misc. Civil Application stands allowed in terms of prayer clause (B). The proceeding of Petition A No. 263/2023 pending in the Court of learned Judge, Family Court, Latur be transferred to the learned Civil Judge Senior Division, Pune where H.M.P. No. 1446/2023 is pending.

(II) After transfer of the proceeding, the learned Judge shall try to dispose of the same as early as possible and preferably within

(III) The applicant-wife shall not seek any unnecessary adjournments. If such adjournments are sought, the Court may pass appropriate order compensating the husband. (IV) If the husband makes a prayer to appear through video conferencing, such prayer be considered liberally by the Trial Court.
