Learned AGP waives service of notice for respondent Nos.1 to 3/State Authorities.

The submissions of the parties reveal that the Commissioner (State Excise), Mumbai heard the appeal against the order of Collector and reserved for judgment. 4.

The grievance of the petitioners is that after hearing the arguments, two months on, yet the judgment is not delivered. Except for this, there is no grievance. However, the Commissioner, State Excise Department, Mumbai has not been

made party. Leave granted to add him as a party. Necessary amendment be carried out forthwith.

Learned counsel for respondent No.4 submits that there was no deliberate delay in delivering the judgment. The Office of the Commissioner has been shifted to new building and it is likely to function fulfledged from 11.03.2024. 6.

In the circumstances, the matter may be disposed of by directing the Commissioner (State Excise), Mumbai to deliver the judgment within two (2) weeks from the receipt of this order.
