Heard the learned APP for the applicant. The learned APP states that delay of only 23 days is caused in filing the appeal against the order of acquittal. Delay is caused for the reasons stated in the application because of the time took place in the correspondence and file was moved from one table to other table. Considering the seriousness of the offence, delay deserves to be condoned. 2.

The learned advocate Mr. Bhosle appears for respondent No. 1. He objected the application for condonation of delay. In his submission, delay is not satisfactorily explained and prays for rejection of the application.

Heard the learned advocates for both the sides. 4.

Considering that the delay is only of 23 days and i.e. caused because of the fact that the file was moving from one table to other table. The delay is only of 23 days. The delay is therefore condoned in the interest of justice.
