CORAM
:
MANGESH S. PATIL & Y. G. KHOBRAGADE, JJ.
DATE : 18.03.2025 PER COURT :
.
In spite of the order permitting the amendment having been passed on 28.01.2025, and in spite of having sought extension of time, which was granted liberally, the amendment has not been carried out. None was present on 04.03.2025. Today, once again, time is sought for carrying out the amendment. 2.
Considering the fact that the petitioner was raising a dispute regarding the auction wherein the contract for excavation of sand from the riverbed was assigned to respondent No. 6 for the year 2023-24, which period has already elapsed, the petition has become 1/2
908 WP NO. 1319 OF 2025 infructuous. If at all, as submitted by learned advocate, the petitioner has any grievance in respect of a subsequent auction process, in which respondent No. 6 has again succeeded in getting a contract, the petitioner could have recourse to an independent process of putting up a challenge.
3.
The petition is disposed of with liberty to resort to the remedy as mentioned hereinabove.
