IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CIVIL APPLICATION NO.15213 OF 2018 IN PUBLIC INTEREST LITIGATION NO.22 OF 2018 Ashok Bapurao Kale ..APPLICANT

VERSUS

The State of Maharashtra & ors.

..RESPONDENTS Mr M. M. Dabholkar, Advocate for applicant;

Mrs A. V. Gondhalekar, A.G.P. for respondent No.1; Mr S. S. Dande, Advocate for respondent Nos.2 & 3 CORAM : PRASANNA B. VARALE AND NITIN W. SAMBRE, JJ.

DATE : 15th March, 2019 ORAL ORDER:

Heard learned Counsel appearing on behalf of the applicant. 2.

By way of present application, two principal prayers are made, firstly, for early hearing of the petition and secondly for grant of interim relief. 3.

We are not inclined to allow both these prayers at this stage, firstly, due to paucity of time it will not be possible to grant early hearing of the petition, which is of the year 2018 i.e. relatively the latest petition submitted to this Court and secondly, insofar as the prayer for interim orders by way of directions is concerned, the grant of this prayer would amount to practically

15213.18ca (2) allowing the petition. As such, we are not inclined to grant this prayer also. Thus, the application is rejected with liberty to the applicant/petitioner to revive his request for early hearing after twelve weeks. (NITIN W. SAMBRE, J.) (PRASANNA B. VARALE, J.) sjk
