The petition is filed on the count that the condition to deposit 2% E.M.D has been relaxed. 2% of the amount of the contract would come to Rs.44,00,000/- (Rupees forty four lacs). By way of corrigendum, the said amount of E.M.D is reduced to

Rs.40,00,000/- (Rupees forty lacs). According to the petitioner, the Respondents could not have changed the condition in the midst of the tender process.

Mr.Suryawanshi, learned counsel on instructions submits that during the extended period not a single tender is received and none of the person who has submitted the tender has deposited E.M.D less than 44,00,000/- (Rupees forty four lacs). 5.
