The judgment delivered in Special Case No. 11 of 2012 is questioned by the State on the ground that the acquittal granted was uncalled for and not justifiable in the set of evidence that was brought before the Court below.

Learned A.P.P., as such, argued for grant of leave to appeal.

Perused the entire proceedings. Prima facie, in my opinion, the case needs consideration.

The prayer is opposed by Mr. R.N. Chavan, learned Counsel holding for Mr. C.P. Sengaonkar, learned Counsel for the respondent, as according to him, once acquittal is granted, this Court will slow in granting leave to appeal.

In my opinion, having heard learned A.P.P. for some time, the case for grant of leave to appeal is made out. Leave granted.
