The learned counsel for the petitioner submits that, the petitioner had given his bid pursuant to the proclamation for sand spot. The petitioner was the only candidate, however, there was stay granted by this Court for allotment of sand spot. The petitioner had deposited 1/3rd amount. The said stay is still in operation. The petitioner has filed an application for refund of the amount on 20.06.2017. No decision is taken on it as yet. 2.

The learned Assistant Government Pleader accepts notice for all respondents and submits that, the authority will decide application of the petitioner on its own merits.

In case application dated 20.06.2017 (Exhibit - G) is pending with the respondent No. 2, then the respondent No. 2 shall take decision upon it, on its own merits, in accordance with law, expeditiously and preferably within a period of four (04) months from today.
