Heard the learned counsel for the parties.

Perused the impugned judgment and the grounds of objections raised in exception to the said judgment.

After having considered the materials as aforesaid, the following order is passed:

ORDER

i) The applicant is permitted to withdraw 60% of the deposited amount on submitting an undertaking to the satisfaction of the Registrar of this Court.

ii) Balance 40% be invested in Fixed Deposit Receipt in nationalized bank for the period till disposal of the appeal.

iv) List the appeal for final disposal on 16.01.2019.
