Heard learned counsel for the parties.

Learned counsel for the applicant refers to the contents of the application and submits that delay has occurred under the circumstances referred to therein.

Learned counsel for the respondents though purported to resisted, yet veracity of the contents of the application is not being overcome any credible material on record.

In the circumstances, having regard to guidelines in Collector, Land Acquisition, Anantnag vs. Mst. Katiji, reported in AIR 1987 SC 1353, and Esha Bhattacharjee vs. Managing Committee of Raghunathpur Nafar Academy, reported in (2013) 12 SCC 649 it appears to be expedient to condone delay.

Civil application, therefore, is allowed in terms of prayer clause (A) and is disposed of.
