Order :- Heard learned counsel for the applicant. Despite service, none appears for respondents No. 1/1 to 1/4 as well as respondents No. 2, 3 and 5.

The matter pertains to the motor accident claim. The appellant Maharashtra State Road Transport Corporation is intending to prefer an appeal against the findings expressed by the learned Motor Accident Claims Tribunal, Aurangabad for awarding compensation in favour of original claimants. There is meagre delay of 46 days.

For the reasons stated in the application, I do not find any impediment to condone the delay. Accordingly, the application is allowed in terms of prayer clause "B". The delay caused in preferring the appeal against the impugned Award dated 05-

2 935-CA-742-17 08-2016 passed by Member Motor Accident Claims Tribunal, Aurangabad in MACP No. 314 of 2010 is hereby condoned. Registry to take requisite steps for further process. 4.

The civil application is allowed in above terms and stands disposed of.
