2] It appears that present petitioner had remained absent before the learned Judicial Magistrate F.C. and therefore, the order directing to pay the maintenance, came to be passed. Against that order, the petitioner had preferred a Revision petition before the Sessions Court. The learned Addl. Sessions Judge found that no illegality was committed by the learned Judicial

3] Upon hearing learned counsel for the petitioner and considering the material on record, in my view, there is no force in the present Criminal Writ Petition. The same is, therefore, dismissed.

4] The petitioner would be at liberty to prefer an application before the learned Judicial Magistrate F.C., for setting aside the ex-party order, which application may be decided on its own merit by the learned Judicial Magistrate F.C. [M.T. JOSHI, J.] kbp
