The applicant is seeking pre-arrest bail in Crime No. 199 of 2015 registered with Shahada Police Station, Tq. Shahada, Dist. Nandurbar for the offences punishable under Sections 376(i), 494, 406, 323, 506 of the Indian Penal Code.

It is the case of the prosecution that, the present applicant has married to Manisha, the complainant and has withdrawn an amount of Rs. 1,30,000/-from her custody by giving her false assurance. It is further claimed that, the applicant has threatened the complainant time and again.

Perused the contents of FIR. Prima facie it appears, that there is a consent theory. Apart from the above, there is delay of about 6 months in lodging FIR. The complainant claims to have married to the applicant for second time.

In view thereof, it will be appropriate, in my opinion, to order release of the applicant on bail. Hence, I proceed to pass the following order.

ORDER

(i) In the event of arrest of the applicant Vansing Dagesing Girase in Crime No. 199 of 2015 registered with Shahada Police Station, Tq. Shahada, Dist. Nandurbar for the offences punishable under Sections 376(i), 494, 406, 323, 506 of the Indian Penal Code, he be released on his furnishing PR bond in the sum of Rs. 15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.

(ii) The applicant shall attend the concerned Police Station every from 18th to 20th January, 2016 between 10.00 a.m. and 12.00 noon and thereafter as and when called by the Investigating Officer.
