Applicant apprehends arrest in connection with Crime No. 0268/2023 registered with Bhagyanagar Police Station, Nanded for the offences punishable under Sections 326, 294, 323, 504, 506 of the Indian Penal Code.

First Information Report indicates occurrence of incident on 16.07.2023 in which the present Applicant is alleged to have caused injury to the informant.

Learned counsel for Applicant submits that offence punishable under Section 326 of Indian Penal Code does not get attracted as there is no grievous injury. He further makes a

Learned APP opposed the application.

Perusal of injury certificate indicates that simple injuries were caused to the informant, as such, offence under Section 326 of Indian Penal Code is not prima facie made out. The Applicant has cooperated in the investigation. As such, his further custody is not necessary. Applicant has no criminal history behind him. He is not likely to flee from justice. He has no abused the liberty. Hence, application is allowed in terms of the interim order. ( R. M. JOSHI) Judge dyb
