From the perusal of the prayer clause made in this writ petition, it appears that the petitioner is seeking direction that respondent no.2 i.e. Superintendent of Police, Jalgaon should entrust the investigation of Crime No.367 of 2019 for the offence punishable under Section 381 of the Indian Penal Code registered with Bhusawal Bazar Peth, Police Station, Bhusawal to Local Crime Branch at Jalgaon as the petitioner is not having faith in the Investigating Officer.

Today, when the matter was called, Shri. A.V. Deshmukh, the learned APP appearing on behalf of State, Superintendent of Police and Police Station In-charge makes a statement that the Investigating Officer who registered the offence i.e. Crime No.367 of 2019 on whom the petitioner was not having faith is already transferred and in his place another Investigating Officer is entrusted with the investigation. In view of this statement, the learned Counsel for the petitioner submits that the purpose for filing of this petition would not now survive.
