Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail as he was arrested in connection with FIR No.0121/2022, dated 17/02/2022, registered with Kotwali Police Station, Ahmednagar, District Ahmednagar, for the offences punishable under sections 409, 420, 467, 468, 471 read with 34 of the Indian Penal Code.

The learned Counsel for the applicant points out the order dated 18/10/2024, passed in Bail Application No.1273/2024 in the case of Anil Chandulal Kothari vs. The State of Maharashtra, wherein the Director of the Bank is granted bail. He further refers to the order dated 15/10/2024 in Bail Application No.1695/2024, wherein the Assistant General Manager is granted bail. He argues that the present applicant's role cannot be higher than that of a director who is directly responsible for the alleged offences. The learned Counsel for the applicant further submits that the 1 of
908 BA 2332-2024 present applicant, who is the Manager of the Bank, Branch Kedgaon, stands on the same footing as the other applicants who are granted bail. Therefore, he seeks bail on the grounds of parity. 4.
The learned APP objects to the grant of bail to the present applicant.

Considering the fact that the applicant was arrested on 10/01/2024, and that his role cannot be higher than that of the Directors who are in control of the bank and who have been already granted bail, the present applicant is granted bail on the grounds of parity.

In view of the above, the application is allowed in the following terms : - a] The applicant shall be released on bail in connection with FIR No.0121/2022, dated 17/02/2022, registered with Kotwali Police Station, Ahmednagar, District Ahmednagar, for the offences punishable under sections 409, 420, 467, 468, 471 read with 34 of the Indian Penal Code, on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.
b] The applicant, upon being released on bail, shall not contact the informant, in any manner whatsoever, during the pendency of the trial.

908 BA 2332-2024 c] The applicant shall co-operate with the trial Court and he shall attend each and every date, unless exempted by the trial Court.
d] The applicant shall not tamper with the evidence of the prosecution and he shall not influence the informant, witnesses and other persons concerned with the case.
e] The applicant, upon being released on bail, shall place on record of the trial Court the details of his Contact Number and residential address with updates in case of any change. 7.
Needless to say, in case of violation of any of the aforesaid conditions, the bail granted to the applicant shall be liable to be cancelled. It is also clarified that the observations made in this order are limited to the disposal of the present bail application. The concerned Court shall proceed further in the matter without being influenced by the observations made hereinabove.

The application stands disposed of.
