Heard the learned counsel for Applicant and the learned APP for the Respondent / State.

The learned counsel for the Applicant submits that this Court has issued non-bailable warrant against Applicant / Accused on 23rd August, 2016. After released on bail, the Applicant was constrained to leave the permanent residence at Soegaon to earn his livelihood and he had shifted to the State of Gujarat in search of better work. The leaned counsel submits that the Applicant has given his present complete address in the State of Gujarat and further placed on record the certified copy of Aadhar card and Pan card. The learned counsel submits that the Applicant is available for hearing of the

appeal and there is no likelihood of his absconding. Due to some gap in communication, the date of hearing could not be communicated to the Applicant / Accused and therefore, this Court has issued nonbailable warrant against him. I have also heard the learned APP appearing for the State. For the reasons stated in the application and considering the above submissions, I am inclined to release the Applicant / Accused on bail. Hence, the following order:

O R D E R

I.

The criminal application is hereby allowed.

II.

Applicant - Sudhakar s/o Baburao Ingle be released on bail on furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with two solvent sureties in the like amount. III.

Bail before the Sessions Court, Aurangabad.

IV.

Hamast allowed.

V.
