The applicant/appellant herein has been convicted for the offence under Section 9(m) punishable under Section 10 of the Protection of Children from Sexual Offences Act and sentenced to undergo rigorous imprisonment for five years and to pay a fine of Rs.5,000/-, in default, to suffer simple imprisonment for three months. 3.

For little over half of the sentence, the applicant had been behind the bars. The applicant is 82 years of age. 4.

Considering the quantum of sentence imposed and the fact that the appeal is not likely to come up for hearing in the near future,

12-Cri.Appln.3945.2019 during pendency of the appeal, the substantive sentence of imprisonment to stand suspended. The applicant be released on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. 5.

The application stands disposed of.
