Learned APP waives service of notice for Respondent / State. It appears from the impugned judgment of conviction that the learned Additional Sessions Judge, Hingoli, has not passed any substantive sentence against the Applicant / Accused and sentenced the Applicant to pay fine of Rs.1,25,000/- in default simple imprisonment for two months.

Since no substantive part of sentence is passed, there is no question of suspension of sentence. Hence, the following order:

Applicant - Madhav S/o Mohanji Jarande, be released on bail on furnishing personal bond in the sum of Rs.5,000/- with one surety in the like amount. II.
