This is the second Application for suspension of sentence and bail.

It is submitted by the learned Advocate for the Applicant/Appellant that the Applicant/Appellant is behind the bars for a period of more than eighteen (18) months and there is no possibility of Appeal being heard finally in the near future. The period of one (1) year has lapsed after rejection of the earlier Application by this Court and the Hon'ble Supreme Court. The co-accused, who is a lady, has been released on bail by order dated 26th November, 2025 passed in Criminal Application No. 3905 of 2025.

The learned APP opposed the Application. She submits that the ground of parity is not available to the present Applicant, as the Applicant in the above referred Application was lady. She submits that the Application be rejected.

There is no dispute that the earlier Application of the Applicant bearing No. 3753 of 2024 came to be rejected on merits by this Court by order dated 05.09.2024. Thereafter, on 17.01.2025, the Hon'ble Apex Court dismissed the SLP as not pressed. The co-convict is released on bail by order dtd. 26.11.2025 on the ground that she was behind the bars for a period little over eighteen (18) months and that there was no likelihood of Appeal be taken up for final hearing in the near future. The Applicant is entitled for the order on the ground of parity. Hence, I proceed to pass the following order: -

ORDER

[i] The Application is allowed.

[ii] The sentence imposed upon the Applicant by the learned Additional Sessions Judge, Udgir, District Latur, vide the impugned Judgment and Order dated 30.07.2024 passed in Sessions Case No. 02/2021, is hereby suspended till the final decision of the Appeal. The Applicant be released on bail on his

3 919appln4509.2025.odt furnishing personal bond of Rs. 30,000/- [Rupees Thirty Thousand], with one or two sureties in the like amount. [iii] Bail before the Trial Court.

[iv] The Application stands disposed off.
