We have heard Mr.Bedre, learned counsel for the petitioner and Mr. Wani, learned counsel for respondent no. 5.

It is submitted that management has sent the proposal of respondent no. 5 for approval as Headmistress. According to the learned counsel for the petitioner, respondent no. 5 is ineligible. 3.
The proposal is already pending with the Education Officer. In light of that, the petitioner may raise objection to the proposal
2 wp 2873.20 before the Education Officer as may be permissible.

If, the case of the petitioner is that respondent no. 5 is wrongly appointed as Headmistress and he is entitled to be appointed, then it would be the case of supersession. The petitioner has also remedy U/Sec. 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977. The petitioner may take steps, as so advised.

In that event, all contentions of the parties are kept open.

With the aforesaid observations, writ petition is disposed of. No costs.
